Terms & Conditions

Article 1 — Business Identity

Payments are processed via Mollie on behalf of Vierbijdrie (KVK: 78463130).

Article 2 — Applicability

2.1. These terms and conditions apply to every offer made by Isola Aperta and to every distance contract concluded between Isola Aperta and the buyer.

2.2. These terms and conditions are made available to the buyer before the conclusion of the agreement.

2.3. By placing an order, the buyer agrees to these terms and conditions.

Article 3 — The Offer

3.1. All artworks on the website are limited edition fine art photographs. Each work is produced in a fixed, limited edition size.

3.2. The offer contains a complete and accurate description of the artwork, including edition size, dimensions, materials, and price.

3.3. Images on the website are a truthful representation of the products offered. Minor colour deviations due to screen settings cannot be excluded.

3.4. Obvious errors or mistakes in the offer are not binding upon Isola Aperta.

Article 4 — The Agreement

4.1. The agreement is concluded at the moment the buyer accepts the offer and meets the conditions set.

4.2. Upon receipt of the order, Isola Aperta will send a confirmation by email.

4.3. Isola Aperta reserves the right to refuse an order or to impose additional conditions, for example in the event of doubt regarding the accuracy of the order.

 

Article 5 — Price and Payment

5.1. All prices on the website are stated in euros and include VAT.

5.2. Shipping costs are not included in the product price and are stated separately at checkout.

5.3. Payment is made via iDEAL or other payment methods available through Mollie.

5.4. Full payment is due at the time of placing the order.

Article 6 — Delivery

6.1. Isola Aperta delivers exclusively within the Netherlands.

6.2. Each artwork is produced to order after purchase. The estimated delivery time is around 2 weeks after receipt of payment.

6.3. Stated delivery times are indicative and not binding deadlines. No rights can be derived from exceeding delivery times, unless explicitly agreed otherwise.

6.4. The risk of damage or loss transfers to the buyer upon delivery.

6.5. Isola Aperta ensures proper packaging of the artwork to prevent damage during transport.

Article 7 — Right of Withdrawal

7.1. As each artwork is produced to order after purchase — specifically printed on fine art paper and hand-framed — the product is manufactured to the buyer's specifications. Pursuant to Article 6:230p(1)(f) of the Dutch Civil Code, the right of withdrawal is excluded for custom-made products.

7.2. By placing an order, the buyer acknowledges that the right of withdrawal does not apply.

7.3. If the artwork is damaged or defective upon delivery, the buyer must report this in writing by email within 48 hours of receipt. Isola Aperta will provide an appropriate solution, such as replacement of the product.

 

Article 8 — Conformity and Guarantee

8.1. Isola Aperta guarantees that the products conform to the agreement, the specifications stated in the offer, and reasonable standards of quality.

8.2. Each artwork is a limited edition and is delivered with a certificate of authenticity, including the edition number.

 

Article 9 — Intellectual Property

9.1. All intellectual property rights to the artworks, including copyright, are held by Isola Aperta and/or the respective artist.

9.2. Upon purchase, the buyer acquires ownership of the physical artwork but does not acquire any intellectual property rights. Reproduction, digital distribution, or commercial exploitation of the work is not permitted without express written consent.

9.3. The buyer is permitted to resell the purchased artwork as a physical object.

Article 10 — Personal Data

10.1. Isola Aperta processes personal data of the buyer exclusively in accordance with the General Data Protection Regulation (GDPR).

10.2. Personal data is used solely for the execution of the agreement and is not shared with third parties unless necessary for the performance of the agreement (for example, shipping).

Article 11 — Complaints

11.1. Complaints regarding the execution of the agreement must be submitted to Isola Aperta by email as soon as possible, with a full and clear description.

11.2. Complaints submitted to Isola Aperta will be responded to within 14 days. If a complaint requires a longer processing time, the buyer will be informed accordingly.

Article 12 — Liability

12.1. The liability of Isola Aperta is limited to the purchase price of the artwork in question.

12.2. Isola Aperta is not liable for damage resulting from improper use, storage, or handling of the artwork by the buyer.

12.3. Isola Aperta is not liable for indirect damage, consequential damage, or loss of profit.

Article 13 — Force Majeure

13.1. In the event of force majeure, Isola Aperta is not obliged to fulfil any obligation. Force majeure includes but is not limited to: disruptions with suppliers, transport issues, natural disasters, government measures, and other circumstances beyond the control of Isola Aperta.

13.2. In the event of force majeure lasting more than 60 days, both parties are entitled to dissolve the agreement without any obligation to pay compensation.

 

Article 14 — Applicable Law and Disputes 

14.1. All agreements between Isola Aperta and the buyer are governed by Dutch law.

14.2. Disputes will preferably be resolved by mutual agreement. If this proves impossible, the dispute will be submitted to the competent court in the district where Isola Aperta is established.
